General terms and conditions

The www.earn-eap.com website (the “Site”) is an online information and communications service (the “Service”) provided by Greater Cincinnati Behavioral Health Services for use by current customers and potential customers of the EAP program. Throughout the Terms & Conditions of Website Use, Be! Wellness Solutions, the EAP and its parent, Greater Cincinnati Behavioral Health Services are referred to as "we" or "us."

Use of the web service is governed by the Terms & Conditions of Website Use, as well as the Privacy and Data Collection Policy. You must read both the Privacy and Data Collection Policy and the Terms & Conditions of Website Use prior to using any portion of the www.earn-eap.com website. Your use of the Site constitutes acceptance both the Terms & Conditions of Website Use and the Privacy and Data Collection Policy. If you do not agree with the Terms & Conditions of Website Use and the Privacy and Data Collection Policy, you may not use any portion of the Site.

We reserve the right to modify the Terms & Conditions of Website Use and the Privacy and Data Collection Policy at any time, and without prior notice, by posting amended terms on this Site. We encourage you to review this agreement periodically for any updates and changes. 


This site and its services are for consumer educational use only. Nothing contained in this site or links provided to other websites is or should be considered, or used as a substitute for medical advice, diagnosis or treatment. The services provided on this site are here to educate consumers on mental health issues that may affect their daily lives. This site and its services do not constitute the practice of any medical, nursing or other professional health care advice, diagnosis or treatment.

We advise users to always seek the advice of a qualified health care provider with any questions regarding personal health or medical conditions. Never disregard, avoid or delay obtaining medical advice from your doctor or other qualified health care provider because of something you have read on this site. We do not endorse, warrant or guarantee any information, products, services or merchandise that is not clearly identified as information, products, or services supplied by us. The external website links provided in the Resources page are believed to be reliable, but because we do not control that information, it is not warranted or guaranteed. Further, we are not responsible for the privacy policies of external website links with respect to anything you do or disclose on such sites. Note also that the EAP does not necessarily have an affiliation with organizations that choose to offer a direct or indirect link from their websites to www.earn-eap.com.

Users' agreement

Users will not use this site for any purpose in violation of local, state, national or international laws.

Users will not hold the EAP or Greater Cincinnati Behavioral Health Servcies liable for damages including (but not limited to) loss of wages, revenue or business because of any services related to or provided by this site. The sole and exclusive remedy for dissatisfaction with the services of this site will be to stop using the Service.

Users will indemnify the Be! Wellness Solutions / Greater Cincinnati Behavioral Health Services , together with any of their respective officers, directors and employees, against any damages, losses, liabilities, judgments, costs or expenses (including reasonable attorneys' fees and costs) arising out of a claim by a third party or user relating to use of the Service, or any breach or violation of this Agreement or any other term or condition contained on the Service.

Be! Wellness Solutions, the EAP, EARN, www.earn-eap.com and the Employee Assistance Resource Network are registered and copyrighted trademarks. Use of these trademarks without written permission is prohibited.
Users agree to comply with all user responsibilities and obligations as stated in these Terms of Service.

Use of cookies

"Cookies" are small pieces of information that some Web sites store on your computer's hard drive when you visit them. We do not use cookies to identify you or to track your use of the www.earn-eap.com website.

Log Files; Web Beacons

The EAP may use log file information sent by your web browser (which may include information such as web request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, and other information) to analyze trends, administer the Site, track the movement of users, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Collection of personal information

This notice applies to all information collected or submitted through the Site. In the Ask the EAP section, there is an opportunity to conduct email exchanges with the EAP staff. These email exchanges may contain personal information about you or a person close to you. The Site Privacy and Data Collection Policy provides additional information on the types of data collected and how we use and protect that data. Also, a separate Terms & Conditions for the Ask the EAP email system is provided in that section.

Unless required (see Required Disclosures below), personal information that you choose to share with us through these emails – including your email address, health interest, and your questions about our program and your health status – is used only for communication and record purposes, and in an aggregate form, to analyze and improve our website and/or business practices.

We use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties. Likewise, we use your phone numbers only to respond to your emails. All information shared in the email exchanges is encrypted for security during transfer over the Internet to our servers. 

We may use non-identifying and aggregate information to better design our website and systems. We collect and track general site traffic, site entrance points and navigation, and length of stay.

Our business customers (i.e., your employer) receive periodic utilization reports that detail the number and types of services that we provide to their employees. Employers use these utilization reports to assess the value of purchasing the EAP service packages. Information that will identify individuals is never shared.

Finally, we will not use or share the personally identifiable information that has been provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

Required Disclosures

The EAP reserves the right to disclose your personal information, without notice, if required to do so by law or in the good faith belief that such disclosure is necessary to: (a) conform to the edicts of law or comply with legal process served on the EAP; (b) protect and defend the rights of the EAP; and (c) act under exigent circumstances to protect the personal safety of users of the site or the public.
